What is the difference between a barrister and a solicitor?

There are two kinds of lawyers in NSW; barristers and solicitors. While both barristers and solicitors are legal professionals, there are key differences in the education, training, and day-to-day practice of a barrister and a solicitor.

  • Barristers are highly trained lawyers who specialise in advocacy on behalf of their clients in a courtroom. To become a barrister, a solicitor must pass the Bar Exam and be admitted to the New South Wales Bar Association.

  • Solicitors are legal practitioners who specialise in many different areas of the law. When solicitors are working on a case that requires going to court, they will often brief a barrister on the specifics of the case so the barrister can appear in court on their, and their client’s, behalf.

Why do I need a barrister to represent me in court?

A barrister spends his or her career in a courtroom. They are trained to appear in front of a judge or magistrate. They are experts at navigating the often complicated and technical world that is the courtroom.
